12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUBBLE LAB AI SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES RESULTING FROM SERVICE INTERRUPTIONS OR TECHNICAL FAILURES
• DAMAGES ARISING FROM THIRD-PARTY ACTIONS OR CONTENT

Our total liability for any claim shall not exceed the greater of:

• The amount paid by you for the Service in the twelve months preceding the claim
• One hundred dollars ($100)

You agree to indemnify, defend, and hold harmless Bubble Lab AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

• Canceling your subscription (service continues until end of billing period)

14.2 Termination by Us

We may terminate or suspend your account if:

• You violate these Terms or our policies
• Your account remains inactive for an extended period
• We determine termination is necessary for legal or business reasons
• You fail to pay applicable fees

14.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• We will delete your data within 30 days unless legally required to retain it
• You may request data export before deletion
• All provisions that should survive termination will remain in effect
• Outstanding payment obligations remain due and payable

15. Dispute Resolution

15.1 Informal Resolution

Before pursuing formal dispute resolution, please contact us at hello@bubblelab.ai to attempt informal resolution. We commit to working with you in good faith to resolve disputes.

15.2 Binding Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration:

• Arbitration will be conducted by the American Arbitration Association (AAA)
• The arbitration will take place in Delaware, United States
• The arbitrator's decision will be final and binding
• Each party bears their own legal costs unless otherwise awarded

15.3 Class Action Waiver

You agree that disputes must be resolved on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitrations.

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, wars, terrorism, labor strikes, government actions, internet outages, or other force majeure events.

17. Export Controls and Sanctions

The Service is subject to export control laws. You agree that you will not:

• Use the Service in violation of any export restrictions
• Export or re-export the Service to prohibited countries or entities
• Provide access to individuals on government restricted lists
• Use the Service for purposes prohibited by applicable export laws

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions. Any legal proceedings (outside of arbitration) will be resolved in the courts of Delaware.
